“The applicant’s condition of epilepsy, which he had medically verified was under control, is a common one and easily stereotyped by employers,” said Shegerian. “To rescind an offer of employment based on stereotypes or biases about a disability would constitute a violation of the federal laws designed to protect disabled workers.”
“Understandably, Amtrak is being extremely cautious about safety issues after recent train accidents. However, every company that falls under coverage of the ADA must also be equally cautious about abiding by its provisions,” Shegerian went on to say. “Under the ADA, disabled workers who meet job qualifications and who can perform the task of a job without limitations have the well-established right to be treated the same as other workers without disabilities.”
