LOS ANGELES– Attorney Cortney Shegerian, of the Los Angeles-based employment discrimination firm Shegerian & Associates, has released comments on the recent disability discrimination allegations launched against the City of San Gabriel and its council members. A doctor has filed claims alleging the City of San Gabriel is in violation of the Americans with Disabilities Act (ADA) for denying a permit for a new dialysis center.

“This will be an interesting case because it highlights the fact that the parameters of the Americans with Disabilities Act are wide enough to apply to municipalities in situations just like these,” said Shegerian. “The ADA is about equality for disabled employees, but it’s also about equal treatment for disabled residents. Cities can be in violation of the Act when they fail to enforce their laws and ordinations in a way that treats disabled residents the same as others.”

“Often small groups of residents in positions of influence and power are pitted against the needs of a disabled group, and the decision-making entity must be careful to stay in observance of the ADA, which clearly prohibits decisions that treat disabled groups differently simply based on the fact that there are disabilities involved that would be difficult to accommodate,” Shegerian went on to say.

“Here, if the allegations of disability discrimination are true, and the claims succeed, it’s going to be a particularly strong win for the disabled community in San Gabriel and establish a precedent of fairness and equal treatment.”
