The suit involves a class of former employees over the age of 40.
“As more and more millennials gain traction in the workplace, we are seeing age discrimination cases increase and come under scrutiny from the EEOC,” said Shegerian. “This case exhibits a familiar pattern in which businesses and companies base hiring practices on a desire for a youthful physical appearance to the detriment of older workers who are equally, or even more, qualified.”
“These preferences become an issue when employers use them to unfairly exclude workers whose only difference is that they are aged 40 or older,” Shegerian went on to say. “Fundamentally, a case like this is the EEOC’s way of ensuring that employers are put on notice of the inherent risks involved in letting discriminatory age preferences govern their hiring policies”, Shegerian commented further.
“By pursuing these kinds of cases, the EEOC is obviously hoping to influence the behavior of employers around the country in an effort to protect the rights of workers aged 40 and older who are just as qualified as the younger workforce.”
