“These preferences become an issue when employers use them to unfairly exclude workers whose only difference is that they are aged 40 or older,” Shegerian went on to say. “Fundamentally, a case like this is the EEOC’s way of ensuring that employers are put on notice of the inherent risks involved in letting discriminatory age preferences govern their hiring policies”, Shegerian commented further.
