“The previous practice of forcing employees to sign arbitration agreement as a condition of employment was extremely problematic from an employment rights perspective,” said Shegerian. “Under the best circumstances, arbitration is a decent solution for both parties. However, problems arise when employers take advantage of arbitration by dominating the process and using these agreements to strip employees of rights they would otherwise have.”
“This is something that can occur when employers are allowed to pay for the arbitration themselves and to manage much of the arbitration process to their advantage,” Shegerian went on to say. “The counter-argument is that the new legislation will drive up court costs and burden the judicial system. However, the courts themselves have the authority to suggest arbitration when needed, and that’s a much better way to address the issue without compromising the rights of employees.”
