Family Leave Cases: Take Advantage of FMLA

FMLA | Shegarian & Associates Can Help You Get the Leave You Deserve

While you do have a certain number of sick days, personal days, and vacation days available to you, you may not be aware of other time off for which you might qualify. Many people who need the additional time to recover from illness, deliver a child, or take care of ill family members do not realize they are covered by the Family Medical Leave Act, or FMLA. You don’t need to hoard your days off to deal with medical issues, though many employers may avoid sharing this information with you in the interest of saving money.

What to Expect

While FMLA leave is certainly a fantastic solution, you must realize you are only entitled to certain assurances. First of all, you will receive pay through a portion of the time off. If you need more time than that, you must understand that it will be unpaid. You can still be certain that your job will be waiting for you when you get back, however. While you are recovering from illness or caring for your new baby, your job will be held for you, so do not allow an employer to tell you otherwise. If you don’t return to work on the specified day, you might not retain that entitlement.

How to Fight Back

If you feel as though you are not being granted the leave you deserve, you can work with an employment lawyer to fight back. Always be sure to keep accurate records of any conversations regarding the issue, and you should have no trouble securing your FMLA.
